2. Data used by this website
Website delivery and security. Our hosting and network-security providers process your IP address, request time, requested page, browser information and technical response data to deliver and protect this website. Legal basis: Art. 6(1)(f) GDPR, our legitimate interest in a reliable, secure website.
Contact. The contact form opens a draft in your email application. It does not submit a message from this website. If you send the email, we receive the contact details and message so we can respond. Legal basis: Art. 6(1)(b) and (f) GDPR.
Accounts and payments. New registration links are disabled on this website. Existing users can sign in to the separate SmarterBrain dashboard. This marketing website does not take payments or connect to your server.
Dashboard data. The product dashboard uses server status, compatibility and action results so the owner can administer the server. This reporting does not collect Hermes conversations, memory or project files. AI and messaging providers process content sent through their connected services.
3. Service providers
Recipients include our hosting provider, Cloudflare for network delivery and security, UAB Sender.lt for newsletter registration, and email providers for messages you choose to send. SmarterBrain does not sell personal data or share it for advertising. The separate dashboard has its own account and service information.
4. International transfers
Sender states that subscriber data is hosted in the European Union. Cloudflare operates a global network, including processing outside the EU/EEA. Its data-processing terms describe applicable adequacy decisions and EU Standard Contractual Clauses. Contact us for information about the safeguards applicable to your data or to request a copy.
5. Retention
Contact messages are retained for handling the enquiry and any resulting legal obligations or claims. Newsletter details are retained while the subscription request or subscription remains active; after withdrawal, only information needed to respect the opt-out or meet legal evidence obligations is retained. Security logs are retained for investigating incidents and protecting the service, with necessity determining retention. Browser session preferences end with the tab session; your analytics choice is valid for 180 days and its stored record is discarded on your next visit after expiry. You can clear it earlier in your browser. You can request deletion or information about the retention applicable to your data at the address below.
6. Your rights
Under the GDPR you can ask us for access, correction, erasure, restriction and portability of your data, and you can object to processing based on legitimate interests. Email hello@smarterbrain.ai. You also have the right to complain to a supervisory authority; for us that is the LDI NRW (Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen).
7. Browser storage and analytics
Analytics is optional. Only after you select Allow analytics do we load our self-hosted Umami service at analytics.smbr.cc. On production it measures pageviews; on staging and production it measures Hostinger-link clicks, including provider and link position. The tracker processes browser language, screen dimensions, page path and technical connection data. We remove URL query strings and referrers and do not send account identifiers. We do not describe this processing as anonymous merely because it uses no cookies.
Legal basis for optional analytics: your consent under Art. 6(1)(a) GDPR and §25(1) TDDDG. Reject analytics or change your choice at any time using Analytics preferences in the footer. Do Not Track and Global Privacy Control override an earlier analytics choice. No advertising trackers or Cloudflare performance beacon are loaded by this release.
Necessary browser storage remembers your analytics choice and your requested newsletter dismissal or carousel-motion preference. These settings serve the choices you make, not advertising, under §25(2)(2) TDDDG. Local previews send no analytics. We do not use this website data for automated decisions producing legal or similarly significant effects.
8. Changes to this policy
If this policy changes materially we will update this page and, where consent is affected, ask you again.
