The simple terms for using smarterbrain.ai. Last updated 29 June 2026.
These terms set out the agreement between you and smarterbrain.ai when you use our website and services. We have written them in plain language so you can read them in a few minutes.
1. What smarterbrain.ai is
smarterbrain.ai provides guidance and tools that help you set up and maintain your own AI assistant (such as Hermes or OpenClaw) on a server you rent and own. We do not host your assistant and we do not hold your passwords or AI logins.
2. Advisory only
Advisory only. smarterbrain.ai provides guidance and tools to help you run and maintain your own AI assistant on your own server. We never hold your passwords, we do not take control of your systems, and we are not liable for any breach, data loss, or outage. Always keep your own backups. Nothing here is professional security advice.
3. Your responsibilities
You are responsible for the server you rent, for keeping your own backups, for the AI provider accounts and keys you use, and for using your assistant lawfully. The final decision on any action on your server is always yours.
4. Limitation of liability
To the extent permitted by law, smarterbrain.ai is not liable for indirect or consequential loss, for data loss or outages on systems you control, or for the acts of third-party providers (your server host, your AI provider). Nothing in these terms limits liability that cannot be limited under German law, including for intent or gross negligence, or for injury to life, body or health.
5. Availability and changes
We may change or pause the service and may update these terms. Material changes will be posted on this page.
6. Governing law
These terms are governed by the law of the Federal Republic of Germany. Mandatory consumer-protection rules of your country of residence remain unaffected.
